Terms and Conditions

1. Introduction

Applicable Terms: Please read the following terms and conditions (“Terms and Conditions”) before accessing or using the website located at https://coursesindoha.com  (the “Website”), and all associated sites linked to https://coursesindoha.com (hereinafter collectively referred to as the “Websites”) in any way. By accessing the content of the Websites you agree to the Terms and Conditions set out herein and also accept our Privacy Policy. If you (“User” or “you” or “your”) do not agree to any of the Terms and Conditions you should not continue to use the Websites and must leave immediately.

coursesindoha is a limited liability company incorporated in the State of Qatar and having CR No. 201016 (“coursesindoha”). It provides and manages professional and creative training programs directly to Users (“User(s)”), including but not limited to:

- various creative and professional skill-building training programs, including, but not limited to, sewing,fashion design, pattern making and   sewing, crochet, embroidery, drawing and painting, creative digital skills, youth empowerment programs, and similar courses (“Training   Services”) (Training Services entails training courses and training materials (“Training Courses” and “Training Materials” respectively), which   may include printed materials, studio sessions, and, where applicable, online documentation); and
- conducting seasonal camps and related educational events; and
- providing 1:1 coaching and other learning support services.

Acceptance: These Terms and Conditions constitute a legally binding agreement between coursesindoha and the User. By accessing, browsing or using the Websites, submitting an enquiry form, communicating with coursesindoha through the Websites, or proceeding with any registration or payment for Services, the User shall be contracting with coursesindoha and shall be deemed to have read, understood, accepted and agreed to be bound by these Terms and Conditions. If these Terms and Conditions (or any part thereof) are not acceptable, such person must not access/use or continue to access/use the Website. In any event, coursesindoha reserves the right to suspend or terminate access to or usage of all or any part of this Website at any time, without any liability to the User and/or any other person.

Updates to these Terms and Conditions: coursesindoha reserves the right to update, change or replace any part of these Terms and Conditions by posting updates and/or changes to the Website, with or without notification to the Users. Any new features or tools which are added to the Website shall also be subject to these Terms and Conditions. Any new version of these Terms and Conditions shall take effect and will govern the use of the Website and the User’s relationship with coursesindoha immediately upon the date of uploading such revised version on the Website. The User’s continued usage/access to the Website following the upload of any changes constitutes acceptance of those changes.

2. Definitions

For the purpose of these Terms and Conditions:

“coursesindoha” means coursesindoha Coaching & Consultancy LLC, a limited liability company registered in the State of Qatar under the Qatari Commercial Companies Law No. (11) of 2015 (as amended), with Commercial Registration No. 201016, being the organizing entity of all Programs and the operator of the Website.

“Program” means any structured learning product delivered by coursesindoha, including but not limited to Courses, Camps, and 1:1 Coaching Programs (together, “Programs”) offered and described on the Website, in brochures, or in other official materials.

“Course” means any multi-session, curriculum-based training Program (for example, without limitation, Basic Sewing Course, Junior Artist, Junior Fashion Designer, Fashion Foundation Accelerator) offered by coursesindoha on fixed schedules and over a defined number of sessions.

“Camp” means any seasonal, time-bound Program offered by coursesindoha during school or public holidays (for example, without limitation, Creative Camp – Summer Edition, Creative Camp – Winter Edition), typically structured on a weekly booking model with pre-planned activities and schedules.

“Coaching” or “1:1 Coaching” means any individualized, one-to-one training, learning support, or mentoring Program offered by coursesindoha, usually sold as pre-paid session packs (for example, 8, 16 or 24 sessions) with personalized goals and flexible scheduling, subject to the applicable Program Admission Terms.

“Program Admission Terms” means any program-specific admission, attendance, validity, payment, refund, cancellation, transfer, and conduct rules issued by coursesindoha for particular Programs (including, without limitation, separate admission terms for Courses, Camps, and 1:1 Coaching), as provided on the Website, in brochures, or otherwise communicated in writing to the User, Student, Participant or Guardian. Program Admission Terms form an integral part of these Terms and Conditions.

“Student” means any individual who has been admitted to and enrolled in a Program following completion of the required admission steps and payment of the applicable Fees, and who has received an Admission Confirmation from coursesindoha.

“Participant” means any individual actually attending or taking part in a Program. For the purposes of these Terms and Conditions, “Participant” may be used interchangeably with “Student” unless the context requires otherwise.

“Member” is an internal term used by coursesindoha to refer to a Student or Participant actively enrolled in a Program. It does not create or imply any corporate membership, partnership, shareholding, or other ownership or equity interest in coursesindoha.

“Guardian” means the parent or legal guardian of a Student or Participant under the age of eighteen (18). For the purposes of these Terms and Conditions, coursesindoha considers individuals who are eighteen (18) years of age or older to be adults capable of entering into agreements in their own name, subject to Applicable Laws.

“Affiliates” shall mean any individual, corporation, partnership, limited liability company, association, trust, unincorporated entity or other legal entity that directly, or indirectly through one (1) or more intermediaries, controls, is controlled by, or is under common control with coursesindoha.

“Applicable Law(s)” shall mean all applicable laws, rules, regulations, guidelines, and statutory or government notifications of the State of Qatar, as well as any other laws that may properly apply to the provision or receipt of the Services.

“Data Protection Legislation” shall mean (a) Law No. 13 of 2016 of the State of Qatar concerning the protection of personal data; and (b) the EU General Data Protection Regulation and any other legislation in force from time to time relating to privacy and/or the processing of personal data and applicable to the provision and receipt of Services under these Terms and Conditions.

“Services” shall mean all services provided by coursesindoha through or in connection with the Website, including without limitation the provision, marketing, administration and delivery of Programs, Training Services, and any ancillary services (such as admissions support, scheduling support, and customer service).

“Training Services” shall mean the training and educational services provided directly by coursesindoha, including but not limited to in-person and/or online teaching sessions, workshops that form an integral part of a Program, studio-based practice, and access to Training Materials.

“Training Materials” means any printed, digital, or other materials, patterns, handouts, guides, exercises, templates, or reference content provided by coursesindoha in connection with a Program, including any associated online documentation (where applicable).

“Order” shall mean any request, booking, or instruction to register for or purchase a Program or other Services placed by the User through the Website, by email, by WhatsApp, in person, or via any other official channel notified by coursesindoha.

“Admission Confirmation” means the written confirmation (including by email or digital message) issued by coursesindoha confirming that a User (or the relevant Student/Participant) has been successfully admitted to a specific Program, following completion of the required admission steps and payment of applicable Fees.

“Privacy Policy” shall mean coursesindoha’s privacy policy as published on the Website and updated from time to time.

“coursesindoha Material” shall mean any Training Materials, video sessions, products, images, photographs (including any person represented in the photographs), illustrations, icons, texts, video clips, music, written and other materials that are owned by coursesindoha or its Affiliates and protected by copyright, design, trademark or other intellectual property laws and under international treaty provisions and national laws worldwide.

“Sensitive Information” shall mean the User’s private financial or payment information including, but not limited to, debit card numbers, credit card numbers, and other payment credentials.

“Software” shall mean any software supplied, used, or made available by or on behalf of coursesindoha in connection with the Website or the Services.

“Terms and Conditions” shall mean these terms and conditions, as amended from time to time.

“User” or “Customer” shall mean any person who accesses or uses the Website or Services for the purpose of viewing information, submitting enquiries, registering for Programs, or otherwise interacting with coursesindoha’s Services, whether or not they subsequently become a Student or Participant.

“User Content” shall mean any information, data, text, messages, reviews, ratings, images or other content that a User submits, uploads, posts, transmits, or otherwise makes available on, through, or in connection with the Website or the Services, including but not limited to enquiries, feedback, Ratings and Reviews.

“We”, “we”, “us” or “our” shall mean coursesindoha.

“Website” shall mean the coursesindoha website available at https://www.coursesindoha.com and all associated sites linked to it and controlled by coursesindoha.

“You”, “you”, or “your” shall mean a User, Customer, Student, Participant, or Guardian, as the context requires.

3. Representation and Warranties

By use of the Website in any manner or taking any action that signifies your acceptance of these Terms and Conditions (including accessing or using the Website), or submitting any enquiry or request for Services, you (the User) hereby represent and warrant that:

• You have read, understand, and agree to be bound by these Terms and Conditions and any future amendments and additions to these Terms and Conditions as published from time to time on or through the Services;
• You are eighteen (18) years of age or older, or, if you are under eighteen (18), your access and/or enrolment is made with the consent and supervision of your parent or legal Guardian, in accordance with Applicable Law;
• You are capable of entering into a legally binding agreement (or are acting with the authorisation of a parent or legal Guardian who is capable of entering into a legally binding agreement);
• You are not barred or otherwise legally prohibited from accessing or using the Website under the jurisdiction in which you reside;
• You have the authority to enter into these Terms and Conditions personally and, if applicable, on behalf of any company, organization or other legal entity you have named as the User and to bind that company, organization or entity to these Terms and Conditions;
• Your participation in using the Services is for your sole, personal or internal business use. When using the services, you agree to comply with all Applicable Laws from your home nation, and the country, state and city in which you are present while using the Services; and
• You may only access the Services using authorized means.

By using the Services, you further agree that:

• You will only use the Services for lawful purposes; you will not use the Services for sending or storing any unlawful material or for deceptive or fraudulent purposes;
• You will not use the Services to cause nuisance, annoyance or inconvenience;
• You will not use the Services, or any content accessible through the Services, for any unauthorized commercial purpose, including but not limited to contacting, advertising to, soliciting or selling to any User or third party contractor, unless coursesindoha has given you permission to do so in writing;
• You will not copy or distribute any content displayed through the Services without prior written permission from coursesindoha;
• You will not create or compile, directly or indirectly, any collection, compilation, or other directory from any content displayed through the Services except for your personal, non-commercial use;
• The information you provide to us when you submit any enquiry, registration, or otherwise communicate with us is accurate, and you will promptly notify us of any changes to such information, and provide us with whatever proof of identity we may reasonably request;
• You will not use the Websites or Software in any way that could damage, disable, overburden or impair any coursesindoha server, or the networks connected to any coursesindoha server;
• You will not attempt to gain unauthorized access to any part of the Website and/or to any service, account, resource, computer system and/or network connected to any coursesindoha server;
• You will not deep-link to the Website or access the Website manually or with any robot, spider, web crawler, extraction software, automated process and/or device to scrape, copy or monitor any portion of the Website or any content on the Website, unless coursesindoha has given you permission to do so in writing;
• You will not copy any content displayed through the Services in any format or media, except as expressly permitted by coursesindoha;
• You will not conduct any systematic retrieval of data or other content from the Website, Software or Services;
• You will not try to harm other Users or coursesindoha, the Website, Software or Services in any way whatsoever; and
• You will report any errors, bugs, unauthorized access methodologies or any breach of our intellectual property rights that you uncover in your use of the Website, Software or Services.

4. Enquiries, Registration and Admission Process

Users may express interest in or apply for Services (including, without limitation, Programs such as Courses, Camps and 1:1 Coaching) by:

• Submitting an enquiry or registration form on the Website (including “talk to an advisor”, “view schedules” or similar forms);
• Contacting coursesindoha using the official contact details provided on the Website; or
• Any other official method notified by coursesindoha from time to time.

Upon receipt of an enquiry or registration request, coursesindoha may contact the User (or, where applicable, the User’s Guardian) to:

• Clarify requirements, answer questions and recommend suitable Programs;
• Share information on available batches, schedules, fees, and Program details; and
• Provide instructions for payment and admission.

A User’s admission into a specific Program shall be confirmed only when:

• The User (or, where applicable, the Guardian on behalf of a Student) has provided all information reasonably required by coursesindoha;
• All applicable Fees (including any enrolment or registration fees) have been paid in accordance with the payment instructions; and
• coursesindoha has issued an Admission Confirmation for that specific Program.

The Admission Confirmation shall be deemed as confirmation of coursesindoha’s acceptance of your registration for the relevant Program and such acceptance brings into existence a legally binding contract between you (or, where applicable, the relevant Student/Participant and/or Guardian) and coursesindoha, subject to:

• these Terms and Conditions; and
• the applicable Program Admission Terms for that Program.

If you do not receive your Admission Confirmation within seventy-two (72) hours after completing the required steps communicated by coursesindoha for a given Program, you should contact us at members@coursesindoha.com (or such other email as notified). No place shall be reserved for you until we have sent your Admission Confirmation.

Program Admission Terms:

• Separate Program Admission Terms may apply to specific categories of Programs, including (without limitation) Courses, Camps and 1:1 Coaching.
• Such Program Admission Terms may address, among other matters, attendance requirements, make-up session rules, Program validity, freezing or deferral, refund, cancellation and transfer rules, conduct and safety requirements, and any Program-specific operational conditions.
• Program Admission Terms may be provided on the Website, included in Program brochures, attached to the Admission Confirmation, or otherwise communicated in writing by coursesindoha.

Program Admission Terms form an integral part of these Terms and Conditions. In the event of any inconsistency or conflict between:

• these general Terms and Conditions; and
• the applicable Program Admission Terms for a particular Program,

the Program Admission Terms shall prevail solely in respect of that specific Program, and these Terms and Conditions shall continue to apply in all other respects.

5. Use of the Website and User Content

The Users can review information about Services, submit enquiries, and request admission to various Programs listed and offered on the Website by coursesindoha.

User Content: coursesindoha may provide you with interactive opportunities through the Website and/or Services, including, by way of example, the ability to submit forms, send messages, or post ratings and reviews (where enabled). You represent and warrant that you are the owner of, or otherwise have the right to provide, all User Content that you submit, post, transmit, and/or otherwise make available through the Services. You hereby grant coursesindoha a perpetual, irrevocable, transferable, fully paid, royalty-free, non-exclusive, worldwide, fully sublicensable right and license to use, copy, display, publish, modify, remove, publicly perform, translate, create derivative works, distribute and/or otherwise use the User Content in connection with coursesindoha’s business and in all forms now known or hereafter invented (“Uses”), without notification to and/or approval by you. You further grant coursesindoha a license to use your name and/or other User profile information for attribution in connection with such Uses, without notification or approval by you.

Feedback: You agree that any submission of any ideas, suggestions, and/or proposals to coursesindoha through any forum, contact form or similar pages (“Feedback”) is at your own risk and that coursesindoha has no obligations (including without limitation, obligations of confidentiality) with respect to such Feedback. You represent and warrant that you have all rights necessary to submit the Feedback and you hereby grant to coursesindoha a perpetual, irrevocable, transferable, fully paid, royalty-free, non-exclusive, worldwide, fully sublicensable right and license to use, copy, display, publish, modify, remove, publicly perform, translate, create derivative works, distribute and/or otherwise use such Feedback.

Ratings and Reviews (if enabled): To the extent that you are asked to rate and post reviews of the Services (“Ratings” and/or “Reviews”), such Ratings and Reviews are considered User Content and are governed by these Terms and Conditions. Ratings and Reviews are not endorsed by coursesindoha and do not represent the views of coursesindoha or its Affiliates. coursesindoha does not assume liability for Ratings and Reviews or for any claims for economic loss resulting from such Ratings and Reviews.

Because we strive to maintain a high level of integrity with respect to Ratings and Reviews posted or otherwise made available through the Services, you agree that:

• you will base any Rating or Review on first-hand experience with the Services;
• you will not submit a Rating or Review in exchange for payment, free training, or other benefits; and
• your Rating or Review will comply with the terms of these Terms and Conditions.

If we determine, in our sole discretion, that any Rating or Review could diminish the integrity of the Ratings and Reviews, we may exclude such User Content without notice.

6. Responsibilities of the User

The User shall:

• Ensure full cooperation with us in all matters relating to the Services;
• Attend the agreed sessions and other activities which form part of the Services (subject to absence for medical or other agreed reasons) and participate fully in group work when required, in accordance with applicable Program Admission Terms;
• Respect the confidentiality of all information acquired during the course of participation in the Services;
• Provide us and our employees, agents and other relevant Affiliates, with any information which may reasonably be required by us in the organization of the Services, including, but not limited to, details in respect of the User, and ensure that such information is complete and accurate in all material respects;
• Review these Terms and Conditions from time to time, which are subject to change at the complete discretion of coursesindoha;
• Inform coursesindoha immediately in case of any breach or unauthorized use of his/her personal Not indulge in any activity which would lead to a violation of any terms and conditions as mentioned herein. We have the right to terminate and/or suspend participation of any such individual or entity;
• Not upload or transmit any information, the content of which is an expression of bigotry, racism, defamation or hatred based on age, gender, caste, religion, race, ethnicity, disability or nationality or is in the nature of being derogatory, slanderous, grossly harmful, objectionable, or disparaging to any third party.

We reserve the right to, without any cost to us, refuse admission, deny you access to, or to require you to leave a course, camp, workshop or any other Service if your behavior is considered disruptive, or likely to cause damage, nuisance, offence or injury, or is in breach of venue rules and regulations or these Terms and Conditions, or is otherwise unacceptable.

7. Rights and Responsibilities of coursesindoha

We shall use reasonable endeavours to provide Services to you in accordance with these Terms and Conditions in all material respects but reserve the right to change the course content of any Service or change the individual mentor or modify any Service (including but not limited to training, trainer, instruction, certification, nature of delivery, or mode of delivery) at any time and without notice.

We shall use reasonable endeavours to meet any specified training or Program dates, but any such dates shall be anticipated dates only and may be subject to alteration at our sole discretion.

We reserve the right to amend these Terms and Conditions if necessary, to comply with any Applicable Law or regulatory requirement, or if the amendment will not materially affect the nature or quality of the Services, and we shall notify the User in any such event where required.

Notwithstanding the above, we reserve the right to cancel the Services at any time, without incurring additional liability to the User. In such circumstances, we will offer (at our sole discretion) alternative dates, a full refund, or a credit note.

8. Payment

You understand that a breakdown of the fees payable by the User (the "Fees") for a given Program may be set out on the Website, in Program brochures, or in the Admission Confirmation or related communications. We reserve the right to make changes to the amount of Fees due, should any changes be made to your study plan and Services, subject to Applicable Law and any Program Admission Terms.

You may be invoiced for Training Materials, where applicable, which, together with the rest of the Fees, shall be payable. The cost of Training Materials may vary depending on the Training Course being availed. Some Services may incur an additional enrolment or registration fee. You may be invoiced for this fee separately, which, together with the rest of the Fees, shall be payable by the payment due date communicated to you.

Payment must be made in QAR (Qatari Riyals) or any other applicable currency offered on the payment interface (“Payment Website”) on our Website or as otherwise instructed by coursesindoha, by any of the modes of payment (including but not limited to bank transfer, debit card, credit card, or local payment methods made available from time to time). If the Customer chooses to pay in a currency other than QAR (where applicable), a foreign currency exchange rate may be applied by the payment processor or card issuer.

coursesindoha takes care to keep all the prices listed correct at the time of publication. The total price for Services ordered will be displayed on the Website or otherwise communicated to you at the time you place your order or confirm enrolment.

coursesindoha has no obligation to itemize its costs, profits or margins when publishing such prices.

coursesindoha reserves the right to change such prices at any time, at its discretion. You are liable for all transaction taxes on the Services provided under these Terms and Conditions (other than taxes based on coursesindoha’s income). Payment will be processed by coursesindoha, using the preferred payment method indicated by you at the time of payment.

Fees for Services: coursesindoha may change the Fees for Services as it deems necessary or appropriate for the business, subject to Applicable Law.

Payment method: We accept online payment via third-parties including, but not limited to, Visa, MasterCard, and other card networks or local payment solutions enabled from time to time. By placing an order or making a payment for Services, you warrant that:

• All payment information provided by you is true and accurate;
• The account you use to pay for the Service has sufficient funds to cover the full transaction amount, and is active and has not expired or been canceled; and
• You are the holder (or an authorized user) of the account you use to pay for your order, and you authorize the full transaction amount of your order to be charged to your designated account.

All payment processing for purchases made in connection with the Websites may be handled through third-party e-commerce service vendor(s) and payment gateways. If you pay by credit card, at checkout we or the relevant payment gateway may perform a standard pre-authorization check on your payment card to ensure there are sufficient funds to fulfil the transaction. If the issuer of your payment card refuses to or does not authorize payment for any reason, you may be notified of this during checkout. Your mode of payment also may be declined if:

• The billing information given does not match the bank records;
• Your card has expired or has been cancelled by the issuing bank; or
• A potential fraud or security issue is detected on your card.

Upon successful payment, your credit card or account (as applicable) will be charged the full transaction amount.

Order Cancellation by User: Services may only be cancelled by you in accordance with the applicable refund, cancellation and transfer rules communicated by coursesindoha for that Program, including in the applicable Program Admission Terms. If you fail to attend all or part of any Training, full payment of the Charges shall still be required unless otherwise stated in the relevant Program Admission Terms or expressly agreed by coursesindoha in writing. If a refund is approved by us, it will be made through the mode of payment as decided by us at our sole discretion. All refunds shall be processed in the same manner as they are received, unless refunds have been provided to the User in the form of credits; in such case, refund amount will reflect in the User’s account based on respective bank or payment provider policies.

No Refunds: Charges paid by you for completed and delivered Services are final and non-refundable. coursesindoha has no obligation to provide refunds or credits, but may grant them, in each case in coursesindoha’s sole discretion and subject to Program Admission Terms and Applicable Law.

9. Third Party Service Providers

You acknowledge and agree that coursesindoha may use independent third-party service providers in connection with the operation of the Website and delivery of the Services, including but not limited to:

• Payment gateways and payment processors;
• Scheduling platforms;
• Communication tools (e.g., email, messaging, video conferencing); and
• Hosting and infrastructure providers.

coursesindoha does not:

• Make any warranties, whether express or implied, regarding the uninterrupted or error-free operation of such third-party platforms;
• Assume any liability if the services provided by such third-party service providers do not meet your expectations, or if you suffer any loss or damage as a consequence of using such third-party platforms beyond coursesindoha’s reasonable control; or
• Assume any liability for any change, alteration, amendment or replacement to the third-party services or platforms.

You might be required to provide your Sensitive Information to approved payment gateways while making the payment. In this regard, you agree to provide correct and accurate debit/credit card details or other requested information to the approved payment gateways for availing the Services. The information provided by you will not be utilized or shared by coursesindoha with any third party other than as required in relation to fraud verification, payment processing, or by law, regulation or court order. You will be solely responsible for the security and confidentiality of your debit/credit card details. We expressly disclaim all liabilities that may arise as a consequence of any unauthorized use of your debit/credit card where such use is not directly attributable to our gross negligence.

We do not endorse any independent third-party service provider beyond the limited technical and operational roles described above. You agree not to attempt to impose liability on or seek any legal remedy from us with respect to any independent actions or omissions of such third-party service providers, except to the extent required by Applicable Law.

10. Fraud or Unauthorized Use

You will be entirely responsible for any unauthorised access or use of your personal or financial information arising from your use of the Website or Services, including any loss/damage or claims suffered/made against coursesindoha, on account of or arising from such unauthorized use/access, except where directly caused by coursesindoha’s gross negligence or wilful misconduct. To assist in preventing unauthorized use, you should comply with the security measures recommended by us from time to time. If you believe your personal or payment details have been accessed or used in an unauthorised manner in connection with a transaction with coursesindoha, you should contact us at the notified email address immediately.

11. Use and Protection of Intellectual Property Rights

All intellectual property rights in or arising out of or in connection with the Services, including any Training Materials or video sessions that are provided by coursesindoha (“coursesindoha Materials”) shall be owned by coursesindoha. No reproductions, scans or copies (wholly or in part) shall be made of the coursesindoha Materials without our prior written consent. Any such breach of this Clause shall amount to immediate termination of your entitlement to use the coursesindoha Materials and/or participate in the Services and we reserve all rights to take any legal actions against such breach.

As between the parties, you shall own all right, title and interest in and to all of your data provided to us for the purpose of the Services. You grant us an irrevocable, unlimited and royalty-free license to use your personal data provided to us for the purposes of providing the Services. Each party warrants that for the purposes of these Terms and Conditions it shall comply with the provisions of our Privacy Policy and the Data Protection Legislation.

The Website is owned and operated by coursesindoha. The visual interfaces, graphics, design, compilation, information, computer code (including source code and object code), products, software, services, and all other elements of this Website provided by coursesindoha are protected by Qatari copyright, patent, and trademark laws, international conventions, and all other relevant intellectual property and proprietary rights, and Applicable Laws.

As between you and coursesindoha, all coursesindoha Materials, trademarks, service marks, and trade names contained on the Website are the property of coursesindoha. You agree not to remove, obscure, or alter coursesindoha’s or any third party’s copyright, patent, trademark, or other proprietary rights notices affixed to or contained within or accessed in conjunction with or through this Website. You irrevocably consent to the exclusive jurisdiction of the courts of the State of Qatar, in connection with any action to enforce the provisions of these Terms and Conditions, to recover damages or other relief for breach or default under these Terms and Conditions, or otherwise arising under or by reason of these Terms and Conditions.

18. Waiver
